Terms of Use

1. Purpose

These terms govern the use of the NEWTZ app, a gym logbook to track your workouts, nutrition, supplements and progress. By creating an account, you accept these terms and the privacy policy.

2. Access and account

• The app is for people aged 16 and over.
• You sign in with your email address and a code sent by email. Keep access to your inbox to yourself.
• You must provide accurate information. Your targets are calculated from it.
• You can delete your account at any time in the app (Profile > My data).

3. Your health comes first

• Calories, macros, supplement doses and suggestions are general estimates. They don't replace the advice of a doctor, a dietitian or a sports professional.
• Talk to a healthcare professional before starting a training program, significantly changing your diet or taking supplements, especially if you have a health condition, are pregnant or are on medication.
• Train with proper technique and weights you can handle. You remain responsible for your training.
• If a coach follows you in the app, their programs and advice are their sole responsibility: NEWTZ provides the tool, not the coaching.

4. Using the app

You agree not to:

• use the app for illegal purposes or to harm other users;
• choose an offensive or hateful first name, username or bio, or one that impersonates someone else;
• try to access other users' data, bypass security or disrupt the service;
• copy, resell or commercially exploit the app or its content.

If you break these rules, we may suspend or delete the account concerned.

5. Community

Buddies. The monthly ranking and duels only work with people you've given your friend code to. The volume shown is based on what everyone logs: play fair.

Social network. The social network is optional and turned off by default. If you turn it on, you create a profile with a username and an optional bio, which all members can find and view. You choose what your profile shows, you can follow other members, post your workouts to your followers' feed and react to posts. You can delete a post or turn off the social network at any time.

Community rules. No abusive, hateful, harassing, sexual, violent or misleading content is tolerated. You are responsible for what you post. You can report a profile or a post and block a member from the app. We review reports as quickly as possible and may remove content, hide a profile or suspend an account that breaks these rules.

6. Food data

Product information partly comes from Open Food Facts, a collaborative database published under the Open Database License (ODbL). It may contain errors: check the label if in doubt.

7. Subscriptions: NEWTZ Premium and NEWTZ Coach

The app is free. Two optional subscriptions are available:

• NEWTZ Premium unlocks advanced features (recaps of past weeks and months, detailed statistics…).
• NEWTZ Coach (€19.99 per month in France) gives access to the coach space described in section 8. It also includes NEWTZ Premium.

The price, length and terms of each subscription are shown clearly before any purchase. Payments go through the App Store or Google Play. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period, in your Apple or Google account settings. A period that has started is not refunded by NEWTZ; refund requests follow Apple's or Google's rules.

8. Coach space

The coach space lets a fitness coach follow up to 20 clients in NEWTZ.

• Joining a coach. The client enters their coach's invitation code in the app. Access is free for the client, who sees what the coach will be able to view before confirming.
• What the coach sees. The client's workouts (exercises, sets, weights, durations) and the feedback they choose to write. Weight and nutrition only if the client agrees to share them, which they can withdraw at any time.
• What the coach can do. Send workouts to their clients and comment on their workouts.
• Ending the follow-up. The client can leave their coach at any time (Profile > My coach), and the coach can remove a client. The coach's access to the data ends immediately.
• Coach commitments. The coach uses their clients' data only to support them, does not copy it outside the app for other purposes and does not share it with anyone. The coach is solely responsible for their professional activity, qualifications and the programs they offer.
• NEWTZ is not involved in the relationship between the coach and their clients, including the billing of the coach's services.

9. Intellectual property

The NEWTZ name, logo, design and app code are protected. Your data belongs to you: you only allow us to use it to run the service.

10. Availability and liability

We do our best to keep the app running without interruption and your data backed up, but we can't guarantee it 100%. We are not responsible for the consequences of using the app in breach of these terms, or for training or diet decisions made based on its estimates. Nothing in these terms limits the rights you have as a consumer under the law.

11. Changes to these terms

These terms may change. The date at the top of the page shows the latest version. If something important changes, we'll let you know in the app.

12. Governing law and contact

These terms are governed by French law, without prejudice to the mandatory consumer protection rules of your country of residence. If you disagree with something, please write to us first at [email protected] and we'll look for a friendly solution.
